The Hong Kong Monetary Authority (HKMA) has taken disciplinary action against Fubon Bank (Hong Kong) Limited (FBHK), imposing a HK$4 million penalty for violations of the Anti-Money Laundering and Counter-Terrorist Financing Ordinance (AMLO). According to the HKMA, the decision follows an investigation into FBHK's compliance systems, triggered by the bank's self-reporting of transaction monitoring failures.

Investigation Findings

The HKMA's investigation, covering the period from April 2019 to July 2022, revealed that FBHK lacked effective procedures for monitoring business relationships with customers. Specifically, the bank failed in managing system changes, addressing a significant drop in transaction alerts, and conducting regular reviews of its transaction monitoring system's scope. Additionally, FBHK did not adequately scrutinize customer transactions or update customer due diligence upon trigger events.

Factors Influencing the Penalty

In determining the penalty, the HKMA considered several factors. These included the gravity of the investigation findings, the necessity of sending a deterrent message to the banking sector, FBHK's cooperation during the investigation, and the bank's efforts to remediate the identified deficiencies. Notably, FBHK has no prior disciplinary record, which was also a consideration in the penalty decision.

Raymond Chan, Executive Director (Enforcement and AML) at the HKMA, emphasized the importance of effective monitoring systems. He stated, "The AMLO requires banks to implement effective procedures for continuous monitoring of their business relationships to detect potential money laundering and terrorist financing activities early. Bank management must ensure that any changes to monitoring systems cover all relevant transactions and that deficiencies are promptly addressed."
